Online platforms
The following information on our internal complaints management system (Art. 20 DSA), out-of-court dispute resolution options (Art. 21 DSA), measures and protection against misuse (Art. 23 DSA) and obtaining self-certifications (Art. 30 para. 1 lit. e) DSA) apply exclusively to users of the services of ScandicEstate, ScandicPay, ScandicYachts, ScandicFly, ScandicTrade and ScandicTrust, which are "online platforms" within the meaning of the DSA.
We may make restrictive decisions regarding the content or accounts of users of our Referral Services if we believe that users are violating the law or our Terms of Service ("Terms"). Examples of such decisions include:
- Restricting or blocking the visibility of user content;
- Complete or partial suspension or termination of our services to users;
- Suspension or closure of a user account;
- Restriction of monetization opportunities for user content;
- Refusal to use our online marketplaces for entrepreneurs that we cannot identify in accordance with the DSA.
We may also decide not to respond to a report of potentially illegal content or content that violates our terms.
Internal complaints management system
If users do not agree with such a decision, they can lodge a complaint free of charge via our internal complaints management system in accordance with Art. 20 DSA. Complaints can be submitted by email to DSA@LegierGroup.com within 6 months of receipt of the decision. If necessary, complainants can be contacted for further information. Complaints are processed promptly, without discrimination, carefully and under the supervision of qualified personnel. You will be informed of the decision without delay.
Out-of-court dispute resolution
In order to settle disputes in connection with decisions from our internal complaints management system, there is the possibility of out-of-court dispute resolution before an authorized body in accordance with Art. 21 DSA. These bodies are impartial, independent institutions that are authorized by EU member states and have the necessary expertise. We cooperate with these bodies within the framework of the legal requirements, but are not bound by their decisions. You will be provided with further details of any appealable decisions. Your rights to assert claims in court remain unaffected.
Measures and protection against misuse
In accordance with Art. 23 DSA, we suspend our services for users who frequently provide obviously illegal content for a reasonable period of time after prior warning. We also suspend the processing of reports and complaints from persons or bodies that frequently submit obviously unfounded reports or complaints. When deciding on a suspension, we evaluate each case promptly, carefully and objectively, taking into account all relevant facts, in particular
- The absolute number of obviously illegal contents within a certain period of time;
- Their relative share of the total number of information or messages provided;
- The severity of the abuse, including the nature of the content and its consequences;
- The intentions of the user or complainant, insofar as these are recognizable.
