Transparency Reports
Pursuant to Art. 15(1) DSA, we are obliged to publish transparency reports annually regarding content moderation activities we have carried out. These reports will be duly prepared after the end of the current business year and made available on our website. For each brand (ScandicEstate, ScandicPay, ScandicYachts, ScandicFly, ScandicTrade, and ScandicTrust) operating a separate online platform, individual reports will be provided.
Reporting Illegal Content
In accordance with Art. 16 DSA, individuals and entities have the opportunity to report information about content they consider illegal on our hosting services on this website – including the online platforms ScandicEstate, ScandicPay, ScandicYachts, ScandicFly, ScandicTrade, and ScandicTrust. You can do this via e-mail at [email protected].
If you wish to submit such a report, please include the following details:
- A sufficiently substantiated explanation of why you consider the information in question to be illegal content;
- A clear indication of the exact electronic location of this information, such as the precise URL address(es), or, if necessary, additional relevant details to identify the illegal content;
- Your name and e-mail address (except for reports related to criminal offenses involving sexual abuse, sexual exploitation, child pornography, solicitation of children for sexual purposes, or incitement, aiding, or attempting such offenses). In these cases, you may report anonymously and contact us by telephone at +49 30 408174005;
- A statement that you are convinced in good faith that your information and allegations are accurate and complete.
We process all reports promptly, carefully, impartially, and objectively. You will receive our decision immediately, along with information on possible remedies.
Online Platforms
The following information regarding our internal complaint management system (Art. 20 DSA), out-of-court dispute resolution options (Art. 21 DSA), measures and protection against misuse (Art. 23 DSA), and the collection of self-certifications (Art. 30(1) lit. e) DSA) applies exclusively to users of services from ScandicEstate, ScandicPay, ScandicYachts, ScandicFly, ScandicTrade, and ScandicTrust, which are considered “online platforms” within the meaning of the DSA.
We may make restrictive decisions regarding the content or accounts of users of our intermediary services if we believe that users are violating the law or our General Terms and Conditions of Use (“Terms”). Examples of such decisions include:
- Restricting or blocking the visibility of user content;
- Complete or partial suspension or termination of our services to users;
- Suspension or closure of a user account;
- Restriction of monetization opportunities for user content;
- Refusal to allow entrepreneurs we cannot identify in accordance with the DSA to use our online marketplaces.
We may also decide not to act on a report about potentially illegal content or content that violates our Terms.
Internal Complaint Management System
If users disagree with such a decision, they can file a complaint free of charge through our internal complaint management system in accordance with Art. 20 DSA. Complaints can be submitted within 6 months of receiving the decision via e-mail at [email protected]. If necessary, complainants may be contacted for further information. Complaints are processed promptly, non-discriminatorily, carefully, and under the supervision of qualified personnel. The decision will be communicated to you immediately.
Out-of-Court Dispute Resolution
To resolve disputes related to decisions from our internal complaint management system, there is the option of out-of-court dispute resolution before an authorized body in accordance with Art. 21 DSA. These bodies are impartial, independent entities approved by EU Member States and possess the necessary expertise. We cooperate with these bodies within the framework of legal requirements but are not bound by their decisions. Further details will be provided with appealable decisions. Your rights to pursue legal claims remain unaffected.
Measures and Protection Against Misuse
In accordance with Art. 23 DSA, we suspend our services for users who frequently provide manifestly illegal content for a reasonable period after prior warning. Similarly, we suspend the processing of reports and complaints from individuals or entities that frequently submit manifestly unfounded reports or complaints. When deciding on a suspension, we assess each case promptly, carefully, and objectively, taking into account all relevant facts, in particular:
- The absolute number of manifestly illegal content within a specific period;
- Their relative proportion to the total amount of information or reports provided;
- The severity of the misuse cases, including the nature of the content and its consequences;
- The intentions of the user or complainant, to the extent they are discernible.
