Legal Foundations

  • Digital Services Act (DDG): Regulations for providers of telemedia, particularly obligations for provider identification, liability regulations, and transparency requirements.
  • Media State Treaty (MStV): Regulates the requirements for broadcasting and telemedia in Germany, particularly regarding content responsibility.
  • Broadcasting State Treaty (RStV): Contains regulations on broadcasting and telemedia.

Liability for Content

According to §§ 8 to 10 DDG, we, as service providers, are not obliged to constantly monitor transmitted or stored third-party information or to investigate illegal activities. Obligations to remove or block the use of information under general laws remain unaffected. Liability is only possible from the time of knowledge of a specific legal violation. Upon becoming aware of such violations, we will remove the relevant content immediately. The place of jurisdiction is Berlin (Germany).

Data Protection and ADV Contract

"LEGIER MEDIA GROUP" has concluded a Data Processing Agreement (ADV) in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG). This ensures compliance with the requirements for the protection of personal data (including Article 17 EU Data Protection Directive, Article 28 GDPR). The ADV contract includes, pursuant to Article 28 GDPR:

  • Who is responsible for data processing?
  • What is the subject and duration of the processing?
  • How is the processing carried out and for what purpose?
  • What type of personal data and categories of data subjects are involved?
  • What is the scope of the authority to issue instructions?
  • To what extent does the data processor have an obligation to inform if an instruction violates data protection law?
  • What obligations and rights does the controller have?

Press Laws and Press Freedom

"LEGIER MEDIA GROUP" and all affiliated newspapers and media comply with applicable press laws, particularly the Berlin Press Law of June 15, 1965. According to Article 5, Paragraph 1, Sentence 2 of the Basic Law (GG), press freedom is guaranteed. The press is free and serves the free democratic basic order. Restrictions on press freedom are only permissible under the Basic Law and the laws based on it.

Role of the Press according to the Berlin Press Law (§ 3)

The press fulfills public tasks by collecting and disseminating news, expressing opinions, providing criticism, and contributing to the formation of public opinion. These regulations apply nationwide in all 16 federal states of Germany.

Journalists’ Right to Refuse Testimony and Seizure Prohibition

In criminal proceedings, journalists have a special right to refuse testimony (§ 53, Para. 1, No. 5 StPO). Additionally, there is a prohibition on the seizure of journalistic material (§ 97, Para. 5 StPO). Restrictions are only permissible if ordered by a judge after careful consideration of press freedom.

Reporting and Limits of Criticism

"LEGIER MEDIA GROUP" and all affiliated newspapers and media report critically without defamatory criticism or incitement of the public (§§ 130, 185 StGB). Any discrimination against minorities is excluded. "LEGIER MEDIA GROUP" refers in this regard to the Berlin Press Law of June 15, 1965 (GVBl. Berlin S. 744), last amended by the law of July 3, 2003, specifically concerning § 3 "Public Task of the Press," which in Paragraph 3 of the law states verbatim: "The press fulfills legitimate interests under § 193 StGB when it collects and disseminates news on matters of public interest, expresses opinions, provides criticism, or otherwise contributes to the formation of public opinion." The media of "LEGIER MEDIA GROUP" are committed to the free democratic basic order and respect the boundaries of what is legally permissible. Public opinions are duly marked.

Commission for Investigating Media Concentration (KEK)

"LEGIER MEDIA GROUP" supports the work of the KEK, which was established in 1997 based on the 3rd Broadcasting Amendment Treaty, and publishes news, information, video, and image services in this context.

Violations of Personal Rights

In cases of violations of personal rights, such as defamatory criticism against editors, cessation and damages will be claimed under §§ 823, Para. 1, 1004 BGB. The place of jurisdiction is Berlin, Federal Republic of Germany.

Notice

Engaging a lawyer for a paid warning without prior notification is considered a violation of the applicable duty to mitigate damages. We also refer in this context to the judgment of the Federal Court of Justice, Aktz. VI ZR 144/11 of March 27, 2012.

Reproduction, inclusion in online services, the internet, and duplication on data carriers such as CD-ROM, DVD-ROM, etc., even in excerpts, may only occur with prior written consent from "LEGIER MEDIA GROUP" or the companies representing them. Commercial resale of the content is prohibited. Text passages may be used within the scope of quotation rights (§ 51 UrhG) with source attribution. All rights are reserved (including uses for text and data mining pursuant to § 44b UrhG).
