1. scope of application
1.1 These General Terms and Conditions (GTC) apply to all contracts concluded between LEGIER Beteiligungs mbH (hereinafter "LEGIER MEDIENGRUPPE") and its customers (hereinafter "Users") for the use of the digital and printed offerings of the 115 daily newspapers of the LEGIER MEDIENGRUPPE worldwide. This includes in particular subscriptions, individual purchases of newspapers and access to digital content and services.
1.2 LEGIER MEDIENGRUPPE offers its products and services exclusively on the basis of these GTC. Any deviating terms and conditions of the user shall not be recognised unless LEGIER MEDIENGRUPPE expressly agrees to their validity in writing.
2. conclusion of contract
2.1 The contract for the purchase of a newspaper or access to digital content is concluded by the user's order and acceptance by LEGIER MEDIENGRUPPE. The order may be placed online, by telephone, by e-mail or in writing.
2.2 In the case of online orders, the user submits a binding offer by clicking on the "Order with obligation to pay" button. LEGIER MEDIENGRUPPE may accept this offer by sending an order confirmation by e-mail or by delivering the newspaper or activating digital access.
2.3 Subscriptions are subject to special conditions which are set out in the respective offer or in the order confirmation.
3. prices and terms of payment
3.1 The prices for the products and services of the LEGIER MEDIENGRUPPE can be found in the respective offers. All prices are in euros and include statutory VAT unless otherwise stated.
3.2 For subscriptions, the subscription price must be paid in advance for the respective billing period (e.g. monthly, quarterly, annually). Payment shall be made by direct debit, credit card or invoice, unless otherwise agreed.
3.3 For individual purchases of newspapers or digital content, the purchase price is due immediately.
3.4 LEGIER MEDIENGRUPPE reserves the right to change the prices for current subscriptions with at least one month's notice. In the event of a price increase, the User shall have the right to cancel the subscription with effect from the date on which the price increase takes effect. 3.5 LEGIER MEDIENGRUPPE shall only conclude contracts for fee-based services with Users who are of legal age and otherwise have full legal capacity.
3.6 The presentation of the individual fee-based offers on the order pages does not constitute a legally binding offer, but rather a non-binding online catalogue. In the case of possible contracts for chargeable offers, the user submits the binding offer to conclude the contract at the end of the order process by clicking on the "Buy now" button or, in the case of Paid Content accesses which are not subject to a charge in themselves, by clicking on the button provided there (e.g. "Redeem" or "Continue" in the case of vouchers). Any confirmation of receipt subsequently sent by LEGIER MEDIENGRUPPE shall not constitute acceptance of the offer. LEGIER MEDIENGRUPPE may accept the user's offer within 5 days of receipt of the order by means of an express declaration. The contract shall be concluded upon receipt of the declaration of acceptance (order confirmation), but at the latest upon provision of the chargeable content. The despatch of the ordered goods and the confirmation of despatch to the user are equivalent to an express declaration of acceptance by BILD; this does not apply if the user - if offered - has selected advance payment as the method of payment. The LEGIER MEDIENGRUPPE is under no obligation to accept the User's offer.
3.8 Different subscription packages consisting of different components or modules may be offered for fee-based digital services. Which packages are available is shown in the relevant offer presentation.
3.9 The use of the fee-based digital offers of the LEGIER MEDIENGRUPPE websites and ad-reduced offers may be restricted to a maximum number of end devices. The user shall be informed of the restrictions in the respective offer. So-called "passes" (i.e. editorial offers on special topics such as the Slim Pass or access to special events such as the Fame Fight Pass) may be limited to a certain period of time. LEGIER MEDIENGRUPPE is authorised to modify the services and benefits offered under the conditions of Section 327r of the German Civil Code (BGB).
4. terms of delivery and service
4.1 Products which may be sold shall be delivered to the delivery address specified by the user. However, LEGIER MEDIENGRUPPE accepts no liability for delays in delivery caused by force majeure or other unforeseeable events.
4.2 Digital content and services shall be made available to the User after conclusion of the contract. Access shall be via a user account which the User must create with LEGIER MEDIENGRUPPE.
4.3 LEGIER MEDIENGRUPPE shall be entitled to temporarily interrupt the provision of content and services if this is necessary for technical reasons or to carry out maintenance work.
5. right of cancellation
5.1 Consumers have the right to cancel the contract within 14 days without giving reasons. The cancellation period begins on the day the contract is concluded.
5.2 In order to exercise the right of cancellation, the user must inform LEGIER MEDIENGRUPPE by means of a clear declaration (e.g. by post, fax or e-mail) of his decision to cancel the contract.
5.3 In the event of cancellation, LEGIER MEDIENGRUPPE shall refund all payments it has received from the User without delay and at the latest within 14 days of the date on which notification of cancellation is received.
5.4 The right of cancellation shall lapse for digital content if the user has expressly consented to LEGIER MEDIENGRUPPE commencing performance of the contract prior to expiry of the cancellation period and the user has confirmed that he/she is aware that he/she will lose his/her right of cancellation upon commencement of performance of the contract.
6. liability
6.1 LEGIER MEDIENGRUPPE shall be liable for damage caused by wilful intent or gross negligence and for damage resulting from injury to life, limb or health.
6.2 LEGIER MEDIENGRUPPE shall only be liable for damage caused by slight negligence if a material contractual obligation has been breached. In this case, liability shall be limited to the foreseeable damage typical of the contract.
6.3 LEGIER MEDIENGRUPPE shall not be liable for damage caused by force majeure or other unforeseeable events.
7. data protection
7.1 LEGIER MEDIENGRUPPE processes the User's personal data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the respective national data protection laws.
7.2 Further information on data protection can be found in the LEGIER MEDIENGRUPPE Privacy Policy, which is available on the Website.
8. final provisions
8.1 The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
8.2 The place of jurisdiction for all disputes arising from or in connection with this contract is Berlin, provided that the user is a merchant, a legal entity under public law or a special fund under public law.
8.3 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.

Contrary to the so-called wisdom that media groups strive for policies that make it easier for them to control markets worldwide, the LEGIER MEDIENGRUPPE favours a prosperous consolidation of the media sector and diversification of the industry. This serves to counteract media bias (pink-slime journalism).
Since "printed newspapers are yesterday's news", the view that standards for editorial independence are required to safeguard free and independent print media and protect professional journalism is only partially applicable. These standards relate to monitoring the implementation of and compliance with all laws and regulations relating to concentration processes, media pluralism, diversity of content and journalistic freedoms. Rather, the aim is to preserve media independence without being captured by political parties or the economy.
